Gites 'Cap de Carrere' ~ 'Contractual Conditions of Bookings' applicable to all bookings of the Gites at this address.
It is understood between we the 'Owners' of 'Cap de la Carrere' and you the 'Guest' that the following conditions apply to your booking of a gite at Cap de la Carrere:

1. The Booking is made by an adult who is not less than 18 years of age at the time of confirming the booking. This person is known as the 'Lead Guest', and is responsible for themselves and other members of the party adhering to the conditions below:.

2. The total number of guests is as agreed on the booking form and may not be exceeded without prior agreement.

3. No 'pets' or animals may be brought to 'Cap de la Carrere' by any guest or visitor. The owners have a private garden and guarantee that your holiday will not be spoilt by other guests or the owners 'pets'.

4. A strict No Smoking policy applies inside the gites. This is to ensure that arriving guests have a gite that does not smell of stale tobacco smoke. Smoking on the patio or in the garden is not a problem.

5. A deposit will secure the property for the agreed time as stated on the booking form. This deposit is returnable, minus 40 euro, if the booking is cancelled and we manage to re-let the gite at the same price or greater. If the property remains empty over the period agreed then the deposit is forfeit. If the property is let for less over the period then an adjustment will be made to cover the loss and the remaining deposit, minus the forty euro, will be returned. Bookings made within one calendar month of the occupancy date must be paid for in full at the time of booking.

6. The balance of the monies due must reach us one calendar month before occupation unless agreed otherwise, or the deposit and booking are forfeit. In the event of cancellation after payment in full has been made the same conditions will be applied as detailed in item 5 above.

7. A €100 cash deposit may be requested on arrival as insurance against loss or damage not covered by the owners insurance, whether due to excess limits on the insurance, or lack of cover for that particular item. As examples this would cover small breakages, damage to linen/bedding, small appliance damage due to misuse, water marks on furniture/bedding etc. The keys to the gite may not be released until this deposit is received by the owner or their representative. You may pay this damage deposit in advance when you forward the final payment, if you so wish. This deposit will be returned in cash minus any deductions as agreed between the guest and the owners. (As yet we have never asked for this deposit as all our guests have been most careful and have usually compensated us with a bottle of wine for any small breakages etc. However the condition is included just in case we have any bad experiences!)

8. The Gite will be vacated by 10.30 on the final day, in a tidy and clean condition. (If there are no new guests due on your day of departure we will be pleased to extend this until mid afternoon.) Any damage or breakages will be reported to the owner prior to vacating the property. (The Gite will receive a full cleaning before the next guests arrive as part of the contract between the owners and the Guest, however the owners expect the gite to be left in a reasonable state. If deep cleaning is required, or contract cleaners needed, then the cost of this will be deducted from the deposit.)

9. On the day of arrival it is agreed the gite is not available for occupancy until 16.30, although you will be welcome to take occupancy earlier if possible, once it is cleaned and ready. Late arrivals, after 11pm, must be by agreement. If you are unavoidably detained then let us know and we will make sure you can gain access to your gite on arrival.

10. There will be no refund for early vacation of the gite, unles we manage to re-let at the same rate. We suggest personal 'vacation insurance' to cover this.

11. No additional over-night visitors are allowed without prior agreement, and there is to be no accommodation of visitors on the property, whether within the gite, camping in the grounds in a car or in a camper van, or any other means. This is in order to protect the interests of all the guests.

12. The use of music systems (without private headsets) is restricted to inside the gites, unless agreed by all guests.

13. The owners will not be liable for any inconvenience caused by the outage of public utilities: Water or Electricity; or any damage or inconvenience caused by acts of nature: Storms, Rain, Frost or Snow. The owners will do their utmost to limit the amount of disruption in the event of any such problem, but can not be held liable.

14. The owners are not responsible for the how the weather may affect your holiday.

15. Liability is limited under the owners insurance, so it is recommended that you have your own holiday insurance scheme in place to cover accident, health, cancellation and theft. Loss or theft of any item, cash or personal effects is not covered by the owners insurance. Likewise, any damage to vehicles whilst in the gite car park is not covered.

16. The owners guarantee that they, or their representative, will be available at all times during your stay to provide you with whatever support or assistance you may require in any matter; unless agreed beforehand that this service is not required or available. You will be provided with contact phone numbers or arrival, and the owners or their representative are always in residence in the main house.

17. The gites are registered as required by the French Authorities and the owners participate in the Trois Vallees tourist area information schemes run by the tourist office in Aspet.

18. The 'property' is 'Cap de la Carrere', the associated Gites, Garden and land that form the whole of the property.

19. The swimming pool and its availability does not form part of the contract, although the owners will do their utmost to correct any problems with the pool as rapidly as possible. (The pool is insured, so any problem should be solved quickly - but we can not guarantee this as part of the contract.) This is a normal exclusion clause for an above ground pool. Although above ground there are easy steps up to a large platform in order to easily gain entry to the pool: These steps are gated and the gate is sprung to the closed position and has an additional safety bolt in order tp prevent access by young children without parental supervision. This gate must only be opened in order to gain access to the pool and may not be left, or jammed open. This is in order to comply with French swimming pool regulations. Children may not be left in the pool, or on the pool steps or pool platform, without parental supervision. The pool is not available between ten at night and seven the following norning or for the months October through to April , although the water temperature usually means that it is only usable between mid May until mid September for those of us who are not used to swimming in the North Sea. It may be out for an hour or so a few times a week for cleaning and chemical addition. It is a shared pool so guests are asked to be reasonable with it's use and to replace the cover if they are the last to use it in the evening.

20. During the Low Season as detailed on the Terms and Rates page (normally form the 1st October until the start of Easter week) it is agreed that an additional charge will be made for electricity as metered at the rate charged to the owners by EDF: Also that any wood supplied by the owners for the stoves in gites Gar and Cagire will be charged for at cost. (As an example, in the coldest weather this could add up to a total extra charge not exceeding €10.00 per day, but would normally be much less than this.) Each Gite has its own electicity meter which will be read and agreed on arrival and before departure, with the rate paid being in accordance with the commercial rate pertaining at the time of use.

The above Conditions are for the protection of your holiday and peace and tranquillity of all the guests. Your understanding of the need to abide by these common courtesy rules is much appreciated.
